Who regulates cannabis in New York?

The New York State Office of Cannabis Management (OCM), with oversight from the Cannabis Control Board. OCM issues all retail and cultivation licenses.

Can I grow cannabis at home?

Home cultivation is permitted for adults 21+ once OCM finalizes specific home-grow regulations. Limits: 3 mature and 3 immature plants per adult, 6 mature and 6 immature per household.

Where can I legally consume cannabis?

On private property with the owner's permission, and in any outdoor location where tobacco smoking is permitted (sidewalks, parks where tobacco is allowed, etc.). Indoor public consumption is prohibited.

What are the penalties for unlicensed cannabis sales?

Operating an unlicensed cannabis retail shop in New York can result in fines up to $10,000 per day and criminal charges. The OCM and NYC Sheriff have actively shuttered unlicensed shops since 2024.

Can I be fired for cannabis use in New York?

New York Labor Law §201-d protects off-duty cannabis use for adults 21+. Employers cannot fire you for legal off-duty consumption unless your role is safety-sensitive or federally regulated.
